I intend to marry soon, my fiancee is 21 and I'm 20. I heard rumors that if we go out to eat, we can make our marriage license and I'm allowed to drink.

Texas law.

My fiance works at resturants 2, we allowed that and the other did not. So if someone can find a source that would be great.

The law states that if you are able to drink you must be 21. If the property is taken from you serve alcohol, they could lose their liquor licenses, even if you bring your marriage license it does not mean your 21 and can drink. It simply indicates that you are married, and that's all.

Even if your fiance has succeeded where they have allowed this to happen, they did something that was illegal for them to do. Since the legal drinking age is 21, they could have obtained in a heap of trouble.

In fact, the legislation states of Texas, if one spouse is the legal age, they are able to give liquor to minors their spouse. They must be present. But if a school does not follow this law, they did not. If you do not believe me look for it. Report Abuse

It is illegal to sell the alcohol to anyone under 21, but a minor can still drink if they are "in the visible presence of, and have the consent of their adult parent, guardian, or his spouse. " Flag

Here is the segment of the law, we are all looking for.
Sec.106.04. ALCOHOL CONSUMPTION by a minor
(B) It is an affirmative defense to prosecution under this section that the alcoholic beverages were consumed in the visible presence of his adult parent, guardian or spouse. Flag

Yes, as others have pointed out, what is legal in Texas. If you need further proof that you can find in the Texas Code of alcoholic beverages. Chapter 106 cites this provision in at least 3 seats. Report Abuse

Straign of the law of the State of Texas. You can read the sections: 106.04 and 106.05. They say that consumption and possession of alcohol by a minor is acceptable if, in the presence of a spouse (over 21 years, no doubt). So you can not buy it, but your spouse can, then you can drink. Flag
